When we say that Baratta Law takes few cases so that we can fiercely focus on your case, what does this mean? Each potential client comes with a story. That story is a potential claim. We choose which stories we believe in strongly enough to justify our commitment.
In the recent past, several clients have reached out for help because medical providers made clear treatment errors. Each was interested in making a claim against the negligent medical providers. Both men almost died. Both men suffered injury caused by clear medical error. Fortunately, neither man suffered permanent injury. We spent time with both clients reviewing the facts, reviewing medical records and understanding the damages caused. We chose in both instances to decline representation. Why do we turn down cases that have true merit?
When we choose to take your case, we are telling you that we believe that your case deserves what it takes to prosecute and take that case before a jury. Once we’ve done our investigation and we’ve committed ourselves to you, we are telling you that we believe the investment of time, money, emotion, and risk is worth the outcome we expect to achieve for you. In the two examples above, the expected outcome simply would not justify, for the client, the investment on behalf of the client.
The simple difference between a belief and a claim is that a claim can be debunked, whereas a belief does not wither away in the face of counter argument, no matter how vigorous, no matter how eloquent and no matter how much pressure is imposed.
When we say the Pledge of Allegiance, we are asserting our belief that our allegiance is owed to our country. When we act as lawyers, we are acting in accordance with the belief that we shall honor the United States Constitution. We believe in family first. We believe in honoring our word. So, when we choose to take on your case, we believe that you are in the right, that you’ve been wronged, that you’ve been horribly harmed, that we can achieve an outcome that serves you and the community fairly. In this, our belief will not be debunked.

One of the most difficult tasks we have is to say “no, we can’t take your case.” It’s a necessity, though, so we can fiercely focus all resources necessary to fulfill the promise that is the belief in your case.
